The Official Reply of the Supreme People's Court Regarding the Issue that the People's Court Does not Accept Any Party's Application for Retrial Due to His/Her/Its Refusal to Accept the Ruling on Dismissing His/Her/Its Application for Reversing the Arbitration Award, adopted during the 1,320th meeting of the Judicial Committee of the Supreme People's Court on July 20, 2004, is hereby promulgated, and shall take effect on July 29, 2004.

We have received the Request for Instructions on Whether the People's Court should Accept Any Party's Application for Retrial Due to His/Her/Its Refusal to Accept the Ruling on Dismissing His/Her/Its Application for Reversing the Arbitration Award (Shan Gao Fa [2004] No. 225). After researching the issue, we reply as follows:
The People's Court shall not accept any party's application for retrial due to the refusal to accept the ruling on dismissing his/her/its application for reversing the arbitration award.
